Expression of Interest Terms and Conditions

1. REQUIREMENTS TO NOTE

1.1 Completion of this form does not guarantee entry into Shepparton Festival.

1.2 Shepparton Festival reserves the right to cancel involvement in the event at any time.

1.3 Please ensure you correctly complete this application and that all relevant documentation is attached and submitted before EOIs close.

1.4 Presenters will need to attend a mandatory briefing session (online if necessary) which will outline requirements for COVID compliance as well as information about the use of our logo and branding.

2. INDEMNITY

2.1 The applicant/s agrees to indemnify and to keep indemnified the Shepparton Festival Committee and management and agents, and each of them from and against all actions, costs, claims, charges, expenses, penalties, demands and damages whatsoever which may be brought or made or claimed against them, or any of them, arising from the applicant/s performance/event or purported performance/event of its obligations under this agreement and be directly related to the negligent acts, errors or omissions of the applicant/s. The applicant/s liability to indemnify the Shepparton Festival shall be reduced proportionally to the extent that any act or omission of the Shepparton Festival Committee and management or agents, contributed to the loss or liability.

3. OTHER

3.1 The Applicant will advise Shepparton Festival Director immediately if there are any changes to your participation including (but not limited to) changes to the originally approved event/project, changes in performers or the need to cancel.

3.2 The Shepparton Festival does not support cultural appropriation. If you are submitting an event/project and you are not from the community/culture that your event aims to represent (e.g. you are not an Aboriginal person but you plan to submit an event that purports to align with our goal of putting First Peoples First), we require you to provide a written rationale for your event/project that also details the consultation process with members of that community/culture. For First Peoples First projects this will include a statement from non-Aboriginal applicants that outlines how your project aligns with the 11 Principles of Aboriginal Self-determination.

3.3 Applicants agree to all reasonable requests for publicity for the event and will make Shepparton Festival aware of any matters that need to be handled with sensitivity and/or may place limits on how Shepparton Festival publicise their event on their behalf (Note: Such matters will not in any way prejudice the applicant’s inclusion in the festival program; your advice to Shepparton Festival helps us proceed in an appropriate and acceptable manner, particularly in terms of culture and/or identity).

3.4 All applicants agree to inform Shepparton Festival if there are any reasons why their images (or those of their associated members) and/or voices as recorded, photographed or filmed during the preparation and performance at the Shepparton Festival should not be broadcast or published by the Shepparton Festival. This includes but is not limited to: TV, Radio, Internet, Magazine, or any other advertising in connection with Shepparton Festival and those participants will not be entitled to any fee for such use.

3.5 All applicants shall conform to the requirements of the Occupational Health and Safety Act (Victoria) 2004, Local Government Act and any Local-Laws, or Regulation made there under and shall be liable for any breach of such Acts, Local Laws, or All other Acts, Statutory Rules, Provisions and Regulation of the Commonwealth of Australia or State of Victoria, for the time being in force shall be complied with.

3.6 The personal information supplied on this form is required in order to provide the service requested. It will be used by the Shepparton Festival Committee and management and stored in our record system for only as long as necessary. During this time, it can be accessed and amended by you, and will only be given to third parties with your consent or as required by legislation.

3.7 The applicant agrees to collaborate with Shepparton Festival’s COVID marshal and submit a COVID plan when required in a timely manner
